Terms and General Conditions of Sale (T&Cs)

2. Age Restriction — Strictly 18+

The Service is strictly reserved for individuals aged eighteen (18) years or older. By creating an account and/or completing any payment, the User declares, under their full and exclusive responsibility, that they meet this age requirement.

The Publisher reserves the right to request proof of age at any time without prior notice. Any account found to be operated by a minor will be permanently terminated without prior notice and without any right to a refund of amounts already paid. The Publisher shall bear no liability whatsoever for false declarations made by the User regarding their age.

3. Purpose of the Service & Ephemeral Visibility

The Site provides a competitive digital visibility service. By making a contribution, the Customer acquires temporary digital visibility on a public leaderboard, ranked in descending order of total cumulative contributions.

Volatile and non-permanent ranking: The ranking reflects the current sum of contributions and is by nature volatile. A higher contribution by another user may cause the Customer's rank to drop at any time and without notice. The Customer expressly acknowledges this competitive and transient nature of the service.

Not an investment or game of chance: The payment does not constitute an investment, a donation, a subscription, or a game of chance. No financial return, prize, or guaranteed duration of visibility is associated with any contribution. The sole and exclusive benefit is temporary placement on the public leaderboard for the duration that the Customer's total contribution remains competitive relative to other users.

4. Accepted Currencies and Payment

Accepted currencies: Payments are accepted exclusively in Euros (€) and US Dollars ($). No other currency will be accepted. Prices are displayed inclusive of all applicable taxes (TTC).

Secure payment: All payments are processed securely via Stripe. By confirming the payment, the Customer authorizes the immediate execution of the leaderboard update as described in Article 5 below.

5. Right of Withdrawal and Immediate Execution of the Service (Article L221-28)

In accordance with Article L221-28, 13° of the French Consumer Code, the right of withdrawal cannot be exercised for digital content or digital services whose execution has begun with the consumer's prior express consent and express waiver of their right of withdrawal.

By completing the payment, the Customer irrevocably:

• (i) expressly requests the immediate execution of the visibility service (leaderboard update);
• (ii) acknowledges that execution begins immediately upon payment confirmation;
• (iii) expressly and irrevocably waives their 14-day right of withdrawal provided under Article L221-18 of the French Consumer Code.

This waiver is definitive and unconditional from the moment the payment is confirmed and the leaderboard is updated. All transactions are therefore final.

6. No Refund Policy

Given the immediate execution of the digital visibility service upon payment and the express waiver of the right of withdrawal set forth in Article 5, all transactions are final and non-refundable under any circumstance, including but not limited to: voluntary abandonment of the account, dissatisfaction with the resulting ranking position, or being outranked by another user at any subsequent time.

Sole exception — Technical failure: A refund may be considered exclusively in the event of a documented technical failure directly attributable to the Publisher that prevents the leaderboard from updating correctly following a confirmed payment. In such a case, the Customer must submit a written refund request to help@pay2top.fr within 48 hours of the transaction, accompanied by: the payment receipt, the exact date and time of the transaction, and clear screenshots evidencing the malfunction. Refunds under this exception are granted at the sole and exclusive discretion of the Publisher following technical log verification.

7. Code of Conduct

The Customer agrees not to use names, links, or content in the ranking that are illegal, offensive, or infringing on third-party rights. We reserve the right to remove any entry that violates these rules without a refund.

No refunds will be granted for content removed or modified due to a violation of this Code of Conduct.

8. Limitation of Liability

The Site is not responsible for any indirect loss of traffic or revenue resulting from the Customer's position in the ranking. The service is provided "as is."

9. Data Protection & GDPR

The Publisher processes personal data (email and profile information) provided via Google Sign-In and payment data processed via Stripe. This data is used solely for service delivery, transaction security, and ranking display. In accordance with the GDPR, Users have the right to access, rectify, or delete their data by contacting help@pay2top.fr. Data is hosted within the EU (Germany) and by our payment processor (USA/Stripe) under standard contractual clauses.

11. Governing Law and Disputes

These terms are governed by French law. Any dispute related to the use of the Site or the execution of these T&Cs shall be subject to the exclusive jurisdiction of the Arras, France.
